Official Rules
The SugarLoot Student Outfit of the Year Photo Contest (the “Contest”) consists of two phases: an “entry phase” and a “voting/judging phase.” The entry phase begins August 19, 2008 at 12:00 PM EST and ends September 2, 2008 at 11:59 AM EST (the “Entry Period”). The “voting/judging phase” begins at 12:01 PM EST on September 3, 2008 and ends at 12:01 PM EST on September 16, 2008 (the “Judging/Voting Period”).
Open to legal residents of the 50 fifty United States and the District of Columbia who (i) are 13 years of age or older at the time of entry, and (ii) are registered members of http://www.sugarloot.com (the “SugarLoot Site”). Void where prohibited or restricted by law.
Sponsor: SugarLoot, a wholly owned affiliate of Alloy, Inc. (“Sponsor”), located at 54 Canal St., 6th Floor, Boston, MA 02114, is the sponsor and administrator of the Contest. Sponsor is responsible for the collection, submission and processing of entries in accordance with these Official Rules, Sponsor’s Privacy Policy located at and all applicable laws.
Entry: To enter the Contest you must be a registered member of the SugarLoot Site. There is no charge to becoming a member of the SugarLoot Site. Through on-screen instructions you will be asked to provide information, including your first and last name, email address, city, state, and date of birth. Members of the SugarLoot Site are required to have their email addresses verified. AS A CONDITION TO WINNING, YOU MUST HAVE PREVIOUSLY VERIFIED YOUR EMAIL ADDRESS BY MEANS OF THE VERIFICATION LINK LOCATED AT THE SUGARLOOT SITE. If you wish to verify your email now, click here
During the Entry Period, you may enter the Contest by visiting the SugarLoot Site and uploading a photo that shows you wearing your best back-to-school outfit (the “Photo”). MAKE SURE THAT NO ONE OTHER THAN YOU APPEARS IN THE PHOTO, AND THAT YOU APPEAR IN THE PHOTO, OR YOUR ENTRY WILL BE DISQUALIFIED. As a condition of entry into the Contest, you hereby represent and warrant that: (1) you either (i) took the Photo yourself or (ii) you obtained authorization from the person who took the Photo to enter the Photo in this Contest, and (2) you and your Photo meet all the eligibility requirements set forth in these Official Rules. In addition, you hereby grant to Sponsor the right and license to post/publish your hoto on the SugarLoot Site in connection with the Contest and to make it available for judging/voting in accordance with these Official Rules.
You may enter the Contest only once during the Entry Period. Additional entries will be disregarded.
Without limiting any other term or condition in these Official Rules, any entry which in the sole opinion of SugarLoot is inappropriate or which otherwise violates SugarLoot’s
Other Eligibility Restrictions: Employees (and such employees’ immediate family or household members) of Sponsor, Columbia TriStar Marketing Group, Inc. (“CTMG”), all prize suppliers associated with this Contest, and the foregoing entities’ respective parents, affiliates, subsidiaries, printers, distributors, advertising and promotional agencies (collectively, the “Contest Entities”) are not eligible to enter the Contest.
Voting/Judging and Judging Criteria: Judging of entries will be done during the Voting Period by members of the public (the “Voters”) who (i) are legal residents of the 50 United States and the District of Columbia and (ii) are 13 years of age or older at the time of voting/judging. Voters need not be members of the SugarLoot Site to vote. The Voters will judge the entries (and award points) in accordance with the following judging criteria:
The outfit’s style (30%) - up to a maximum of 3 points may be obtained The overall look of the outfit (20%) - up to a maximum of 2 points may be obtained How “creative” the outfit is (30%) - up to a maximum of 3 points may be obtained How “comfortable” the outfit appears to be (20%) - up to a maximum of 2 points may be obtained
Sponsor shall have the right in its sole discretion to maintain the integrity of the Contest including to void votes or disqualify entrants, for the following reasons:
Multiple votes from the same user from different IP addresses; Use of mechanical or automated voting applications or scripts; Fraudulent entry votes (using redirect link, disguised link, or other method to bypass the legitimate voting channels of the Contest); Inappropriate conduct to induce voter action (for example but not limited to, the use of spam transmissions, harassment, or the payment or granting of consideration) For any other reason as determined by Sponsor in its sole discretion for insuring and maintaining the integrity and overall fairness of the Contest or as otherwise provided in these Official Rules.
Prizes:
One Grand Prize will be awarded. The Grand Prize consists of: one (1) $500.00 gift certificate from WakeUpFrankie.com, one (1) laptop with a custom skin from DecalGirl.com (Approximate Retail Value (“ARV”) $780.00), one (1) $300.00 gift certificate from BagHaus.com, one (1) $150.00 gift certificate from EZSchoolSupplies.com, and one (1) “The House Bunny”–themed makeup case and nail file (ARV $15.00). Gift certificates are subject to terms and conditions of the respective issuers.
ARV OF THE GRAND PRIZE: $1,745.00
Five (5) First Prizes will be awarded. Each First Prize consists of: one (1) $15 makeup gift certificate, and one (1) “The House Bunny”-themed makeup case and nail file (ARV $15.00). Gift certificate is subject to terms and conditions of the issuer.

TOTAL ARV OF ALL PRIZES: $1895.00
Prize Winner Selection: Subject to the tie breaking procedure that follows, the entry garnering the highest average score will be the potential Grand Prize winner of the Contest. Subject to the tie breaking procedure that follows, the five (5) entries with the next highest average scores in descending order will be the potential First Prize winners. The average score is calculated by adding all the grades and dividing the sum by the total number of votes cast for the applicable entry. An entry must have obtained a minimum score of 7 in order to be eligible for any prize award. In the event of a tie for the Grand Prize winner category, a Sponsor-designated judging panel will determine the Grand Prize winner utilizing the Voter judging criteria and averaging the score as set forth in this paragraph. If a tie still exists after the judge’s initial determination, the process shall be repeated until a winner is determined. The losing entrants will be deemed potential First Prize winners. In the event of a tie of one or more entrants for the First Prize winner category, a Sponsor-designated judging panel will determine such First Prize winner utilizing the Voter judging criteria and averaging the score as set forth in this paragraph for all such tied entrants. The resulting losing entrant(s) of such tie breaking procedure will be placed in a position in descending order below that of the resultant winning entrant. If a tie still exists after the judge’s initial determination, the process shall be repeated until a winner is determined and all five First Price category potential winner positions have been filled.
General Conditions Applicable to Prizes, Potential Prize Winners: Each potential winner will be notified by email. The potential winner must accept the prize award within three (3) business days of notification. Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential Grand Prize winner (or if the potential prize winner is a minor, then the parent or legal guardian of such potential Grand Prize winner) may be required to sign and return an affidavit of eligibility and release of liability within five (5) days of receipt unless an extension is granted by Sponsor in its sole discretion. In the event of non-compliance within this time period or if the prize is returned, refused, or returned as undeliverable or if the potential winner violates the Official Rules, then prize will be forfeited and the potential winner disqualified. If the Grand Prize is forfeited, then the First Prize winner with the next highest average score below the disqualified entrant will be deemed the potential Grand Prize winner and the entrant with the seventh highest average score will be deemed a potential First Prize winner. If a First Prize is forfeited, then the entrant with the highest average score below that of the fifth First Prize winner (potential or awarded) will be deemed a potential First Prize winner. No substitution or transfer of a prize is permitted except by Sponsor. First prize winners will be awarded prizes that will be sent directly subject to eligibility verification.
Sponsor reserves the right to substitute any prize, or any portion of a prize, for another prize of equal or greater value. The ARVs set forth in these Official Rules represent Sponsor’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of a prize turns out to be less than the stated ARV, the difference will not be awarded in cash.
General Conditions: The Contest is governed by the laws of the United States and New York. All federal, state and local laws and regulations apply. Prize will only be awarded and/or delivered to addresses within the United States. All taxes, fees, and surcharges are the sole responsibility of the prize winner(s).
Except where prohibited by law, (a) each Entrant grants permission for Sponsor to use the Entrant’s name, biographical information, and his/her Photo solely in connection with the Contest only, and (b) each winner grants (and agrees to confirm that grant in writing) permission for Sponsor to use the winner’s name, biographical information, and his/her Photo for advertising and/or publicity purposes in connection with the Contest only, each without notice, review, approval, or additional compensation. Entrants further agree that none of the Contest Entities, nor any of their respective officers, directors, employees, representatives or agents (together, the “Released Parties”) will have any liability whatsoever for, and shall be held harmless by entrants (and parents/legal guardian if entrants are minor) against, any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation or inability to participate in this Contest. The Contest Entities expressly disclaim any responsibility or liability for injury or loss to any person or property in connection with the delivery and/or subsequent use of the prizes awarded, and make no representation or warranty concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations apply. Sponsor will not replace any lost or stolen prize items.
Conduct: The Official Rules will be posted at the SugarLoot Site throughout the Contest Period. Entrants further agree to be bound by the decisions of, as applicable, the Sponsor and the Voters, which are final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or any website associated with the Contest; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY DELIBERATE ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SUGARLOOT RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitations of Liability: None of the Contest Entities are responsible for (i) any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error, which may occur in the processing of submissions in the Contest, (ii) any misdirected or lost mail, or any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, or (iii) any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to entrants’ or to any other person’s computer related to or resulting from participating or downloading materials in the Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest. In the event of a dispute concerning who registered online to participate in the Contest, the entry will be declared to have been made by the authorized account holder or the email address submitted at the time of registration. The authorized account holder is defined as the natural person who is assigned to an email address by an internet provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the email address. If a dispute cannot be resolved to Sponsor’s satisfaction, the entry will be deemed ineligible.
